INTRODUCTION

The present general terms of use (hereinafter referred to as the "Terms") aim to legally frame the conditions under which the Site https://www.thediceguild.com/ (hereinafter referred to as the "Site") and its services are made available by the publisher of the Site, referred to as “we,” and to define the conditions of access and use of the services by the “User.” These Terms are accessible on the Site under the “Terms of use” section in the footer.

ARTICLE 1: ACCESS TO THE SITE

The Site allows the User free access to the following services:

  • creating an account,
  • logging into the User's account,
  • accessing a personal calendar,
  • the ability for the User to fill their availability up to 45 days in advance,
  • defining a typical week,
  • setting daily and half-day schedules,
  • dividing days into half-days or hours,
  • creating a limited number of game sessions per month,
  • receiving game session reminder notifications via email or Discord.

The Site is accessible free of charge from any location to any User with Internet access. All costs incurred by the User to access the service (computer hardware, software, Internet connection, etc.) are their responsibility.

Non-User members have access only to the homepage, About, Contact Us!, Terms of Use, Personal Data Protection Policy, Legal Notice, Code of Conduct and account creation. To access reserved services, they must register by filling out the form. By agreeing to register for reserved services, the User member agrees to provide truthful and accurate information regarding their contact details, especially their email address. Registration is free, but certain advanced features may require payment. Additional terms for these features will be communicated when they are made available. By accepting these Terms, the User acknowledges being informed of the possibility of paid services and their associated conditions.

To access the services, the User member must then log in using their username and password chosen by themselves during registration. We reserve the right to deny access to services to any person at any time, for any reason.

Each User agrees to create and use only one personal account to access the services offered by the Site. The creation of multiple accounts by the same user is strictly prohibited, unless expressly authorized by the publisher.

Any regularly registered User members can also request to unsubscribe by visiting the dedicated page in their personal account. This request will be processed within a reasonable timeframe.

Any event due to force majeure resulting in a malfunction of the Site or server, and subject to any interruption or modification for maintenance, does not hold the Site or us liable. In such cases, the User agrees not to hold the publisher responsible for any interruption or suspension of service, even without prior notice.

ARTICLE 2: FOR ADULTS ONLY

ARTICLE 4: INTELLECTUAL PROPERTY

The trademarks, logos, signs, as well as all content on the Site (texts, images, sound, etc.) are protected under the Intellectual Property Code and specifically by copyright law.

The User must obtain prior permission from the Site for any reproduction, publication, or copying of the various contents. The User agrees to use the Site's content strictly for private purposes; any use for commercial and advertising purposes is strictly prohibited.

Any total or partial representation of this Site by any means whatsoever, without the express authorization of the Site operator, would constitute infringement punishable by articles L 335-2 and following of the Intellectual Property Code.

By publishing content on the Site, the User grants the publisher a non-exclusive, royalty-free, worldwide, and perpetual license to display this content on the Site. This license is limited to displaying the content on the Site and does not confer any other rights to the publisher. The User undertakes to comply with current French legislation. The Site's liability cannot be engaged in case of force majeure or unforeseeable and insurmountable action of a third party.

ARTICLE 7: USER PUBLICATIONS

The Site allows User members to publish the following content:

  • Role-playing game sessions including title, universe, required character level, description, minimum and maximum number of players, players, duration, date and time, location and/or platform and/or platform link.
  • User profilewith a description, a pseudonym, and a profile picture.

In their publications, User members agree to adhere to Netiquette rules (internet etiquette guidelines) and current legal regulations.

The Site may moderate publications and reserves the right to refuse their publication without having to justify this decision to the User member.

The User member retains full ownership of their intellectual property rights. However, by publishing content on the Site, they grant the editor a non-exclusive, royalty-free right to represent, reproduce, adapt, modify, distribute, and display their publication, directly or through authorized third parties, worldwide, on any digital or physical medium, for the duration of intellectual property rights. The User member specifically grants the right to use their publication on the internet and mobile telecommunications networks. The editor agrees to credit the User members' name near each use of their publication.

Any content uploaded by the User is solely their responsibility. The User agrees not to publish content that may harm the interests of third parties. The User will bear all costs in case of legal action brought by a third party against the Site.

User content may be deleted or modified by the Site at any time and for any reason without prior notice.

If we request specific content submissions from you (e.g., in contests) or if you send us creative ideas, suggestions, proposals, plans, or any other material without our solicitation, whether online, by email, by mail, or otherwise (collectively referred to as "feedback"), you consent to us having the right, at any time and without restriction, to edit, copy, publish, distribute, translate, and otherwise use in any medium any feedback you send us. If no amicable resolution is reached concerning a dispute between the parties, the French courts shall have exclusive jurisdiction to settle the matter.
